A living will is a legal document which is prepared when a person is mentally competent which will dictate a person's wish not to be kept alive on life support machines after they may become brain dead in a serious accident or from an illness.
A durable power of attorney is a legal document which authorizes one person to act on behalf of the individual granting the durable power of attorney to make financial and/or medical decisions on the individual's behalf should the individual become incapacitated.
"Durable" means the power of attorney survives if the individual preparing it becomes incapacitated. If no durable power of attorney is prepared and the individual becomes incapacitated, the court will appoint a guardian or conservator to make the decisions.
